4.15.14 Physician Agreements
A. Purpose
To ensure appropriate review and approval for physician agreements.
B. Persons Affected
All faculty, staff, and students at the University of Texas at Tyler (UT Tyler) and the University of Texas Health Science Center at Tyler (UTHSCT), including off-campus instructional sites, (collectively the “University”).
C. Definitions
President's Delegate – Individual who has written delegated authority to execute and deliver contracts on behalf of the UT Board of Regents.
D. Policy and Procedures
- The University enters into agreements with physicians in accordance with UT System Board of Regents Rules and Regulations, Medical Staff Policies and Procedures, University Handbook of Operating Procedures (HOP), and University Medical Staff Bylaws, Rules and Regulations. All physician agreements are in writing, and except standard employment agreements, must be reviewed by the Physician in Chief and Legal Counsel to ensure compliance with current applicable laws and policies. All agreements must be approved by the President or the President's Delegate, be based upon fair market value, and not consider the value or volume of referrals in any way.
Enforcement
- Violation of this policy may result in disciplinary action that may include termination for employees and temporaries; a termination of employment relations in the case of contractors or consultants; dismissal for interns and volunteers; or suspension or expulsion in the case of a student. Additionally, individuals are subject to loss of University Information Resources access privileges, civil, and criminal prosecution.
